Griffith University's traffic and parking regulations are defined and regulated under the 'Griffith University Act 1998', the State Penalties Enforcement Act 1999, and the State Penalties Enforcement Regulation 2000.
What is an infringement notice
Griffith University campuses are regularly patrolled to ensure an orderly scheme of parking is enforced and infringement notices issued to vehicles found to be in breach of traffic or parking regulations. Offences range from a half penalty unit to a full penalty unit. Currently one penalty unit equals $100.00 and half a penalty unit equals $50.00. The notices are placed under the windscreen wiper of the vehicle.
Why did I receive an infringement
A valid parking permit is required to park a vehicle (other than a motor cycle in a motor cycle zone or bicycle in a bicycle zone) on site for any period between the hours of 8am and 7pm Monday to Friday (except as signed and on Public Holidays). Failure to display a current valid parking permit can lead to an infringement notice and a penalty unit charge (regardless of whether you own a permit or not). Be careful not to park in No Standing Areas (against yellow lines or yellow hatched areas), against expired parking meters, or in parking areas for which you do not have a valid permit.
Options after receiving an infringement
Option 1: Pay in Full by Due Date

- Payment by phone on 3735 7315 (choose option 3) (Bankcard, MasterCard, Visa or Amex) between 9am - 4.30pm, Monday - Friday.
- Payment by cheque/money order made payable to Griffith University to the Parking section.
- Payment of the full amount to any Griffith University cashier between 9am - 4.30pm, Monday - Friday.
- If Griffith University receives your full payment within 28 days from the date of this Infringement Notice, the infringement will be finalised and no further prosecution or enforcement action will be taken against you.

Option 2: Election for Court Hearing
You have the right to elect to have this matter dealt with by a Magistrates Court. The Election for Court hearing notification must be completed and forwarded to Griffith University before the due date printed on the front of the ticket to be completed by the alleged offender. If the University wishes to proceed with the infringement notice, the infringement notice will be lodged with the local Magistrates Court. You will be responsible for obtaining your own legal advice before the court hearing. If found guilty of the offence, you may be fined and required to pay additional costs. If you do not appear on the date set for the hearing, the offence may be heard in your absence.
Option 3: Apply for a Waiver
If you feel that you have extenuating circumstances and wish to appeal, you can do so by completing an online waiver application or you can download a waiver application form (PDF 100k). For waiver to be given appropriate consideration please complete the form in full, making sure to write legibly and include your current postal address. This form needs to be submitted before the due date printed on the front of the infringement notice (or the expiry date of the unpaid Infringement Reminder) to the Parking Section.
In which event, Griffith University may withdraw the Notice, or remit the penalty in whole or in part, or allow the Notice to stand, as may be considered appropriate in the circumstances. You will be notified, in writing, within 15 working days of the decision. if you do not receive a response after this period please contact the Parking Section.
Option 4: Lodge a Statutory Declaration
If you were not responsible for the offence you should supply to the University before the due date printed on the front of the infringement notice (or the expiry date of the unpaid Infringement Reminder) a statutory declaration witnessed by a Justice of the Peace or Commissioner of Declaration giving the name and the current address of the person in charge of the vehicle at the time as well as the infringement number and vehicle registration number. If the registered owner is listed as a company under the state penalties Enforcement Act 1999, Part 3, Division 2, section 17. (5) "A declaration by an executive officer of a corporation must be under the common seal of the corporation". Post the original to Parking section. This only applies if:
- The vehicle was being used by another person;
- The vehicle was sold prior to the date of the alleged offence;
- The vehicle was subject to a hire agreement at the time of the offence;
- The vehicle was stolen or used without your knowledge (copy of the police report or insurance claim to be attached).
Further Action by Griffith University
Infringement Notices issued by Griffith University comply with the provisions of the State Penalties Enforcement Act 1999. You have only 28 days from the date of issue shown on the notice (or the expiry date of the unpaid Infringement Reminder) to choose one of the options offered. If you do not choose an option within 28 days, the infringement notice can then be lodged with SPER who has powers under law to take any of the following actions:
- Suspend your drivers licence, or your ability to obtain a drivers licence;
- Give a Fine Collection Notice to your bank ordering the transfer of money from your bank account;
- Give a Fine Collection Notice to your employer ordering the deduction of money from your wages;
- Give an Enforcement Warrant to an Enforcement Officer to seize and sell your property;
- Give an Arrest and Imprisonment Warrant to a Police Officer.
If no action is taken
From the issue of the original Notice of Alleged Breach, you are given 28 days from the date of the infringement to pay the original amount. If no action is taken during this period a registered owner's search fee is added with an Unpaid Reminder Notice being sent to the registered owner with an additional 28 days to pay the new amount outstanding. If payment or correspondence in the form of a Waiver Application Form (PDF 100k) or 'Statutory Declaration' (see above) is not received after this time (being 56 days from the date of the offence) a lodgement fee is added to the cost for processing and lodgement to the SPER. Once an infringement is lodged with SPER the University will no longer accept any correspondence in regards to this matter. You will need to contact SPER directly for any matters regarding this infringement.
